1. Acceptance of Terms & Eligibility
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and HumTum Live Media & Technologies ("HumTum Live", "we", "us", or "our"), governing your access to and use of our mobile applications, web platforms, and associated services.
Strict Age Restriction: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to register an account or use HumTum Live. By creating an account or accessing live streams, you affirm that you are 18 years of age or older.
If you do not accept these Terms in their entirety, you must immediately discontinue use of the platform and uninstall the application.
2. Account Registration & Security
To access live streaming, audio rooms, and gifting features, you must create a verified account:
- Accurate Information: You agree to provide true, accurate, and complete information during registration and keep your profile details updated.
- Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials (passwords, OTPs, and social login tokens). Any activity originating from your account will be deemed your authorized act.
- One Person, One Account: The creation of multiple fraudulent accounts, automated bots, or impersonation of another person, celebrity, or streamer is strictly prohibited and subject to immediate permanent ban.
- Unauthorized Access: You agree to notify us immediately at admin@humtumlive.com if you suspect any unauthorized breach or access to your account.
3. Live Video & Voice Room Conduct
HumTum Live thrives on creativity, positivity, and safe entertainment. When broadcasting live video, speaking on audio seats, or participating in chat:
- Host Responsibility: As a live host or audio room admin, you are responsible for maintaining a positive, lawful environment within your room.
- Fair Gameplay: In PK battles and interactive party games (e.g. Ludo), you agree not to exploit glitches, use third-party cheat software, or collude to manipulate server leaderboards.
- License to Broadcast: By streaming on HumTum Live, you grant us a worldwide, royalty-free, sublicensable license to host, display, and distribute your broadcast content across our platform for the duration of the stream.
4. Prohibited Content & Zero-Tolerance Policies
HumTum Live enforces a zero-tolerance policy against violations. You strictly agree NOT to broadcast, post, upload, transmit, or share any content that:
Immediate Permanent Ban Offenses: Any content involving child sexual exploitation, illegal narcotics, violent extremism, terrorism, non-consensual sexual media, or severe criminal acts results in immediate permanent device and account termination, with mandatory reporting to law enforcement agencies.
- Nudity & Sexual Content: Any depiction of sexual acts, pornography, genital nudity, suggestive exposure, or solicitation of adult services.
- Harassment & Hate Speech: Bullying, stalking, threatening, defaming, or disparaging individuals based on religion, caste, race, nationality, gender, sexual orientation, or disability.
- Violence & Self-Harm: Displaying self-harm, suicide threats, torture, physical violence, dangerous stunts, or animal cruelty.
- Fraud & Illegal Financial Schemes: Promoting pyramid schemes, unauthorized cryptocurrency trading, unlicensed betting/gambling, money laundering, or phishing.
- Black Market Coin Sales: Buying, selling, or transferring HumTum Live coins outside authorized official channels or authorized resellers.
- Intellectual Property Infringement: Broadcasting copyrighted television broadcasts, movies, or unlicensed music without legal authorization.
5. Virtual Coins & Gifting Economy
HumTum Live incorporates a digital gifting economy powered by virtual coins ("Coins"):
- Limited License Only: Coins and virtual animated gifts (roses, crowns, supercars, rockets) are digital entertainment tokens licensed solely for use within HumTum Live. Coins do not constitute legal tender, currency, or cash balances, and hold zero monetary value outside the application.
- Non-Transferable: Coins cannot be traded, bartered, or exchanged for fiat currency with third parties, except through our officially verified Coin Reseller Program and streamer guild payouts managed by verified administrators.
- Double-Entry Ledger Accounting: Every coin transaction is cryptographically registered in our atomic database ledger. Any coins acquired through system exploits, fraudulent chargebacks, or unauthorized scripts will be instantly revoked.
6. Payments, In-App Purchases & Resellers
Coins can be purchased directly via:
- Official App Stores: Google Play Billing and Apple App Store in-app purchases. All purchases are governed by the respective billing terms and pricing displayed at checkout.
- Authorized HumTum Reseller Network: Verified business partners and agencies registered with HumTum Live can distribute coin batches under authenticated reseller agreements. Always ensure you are transacting through an official reseller verified on admin@humtumlive.com.
7. Refund Policy
All Purchases Are Final: Due to the immediate digital delivery and real-time consumption of virtual coins and virtual gifts, all coin purchases are final, non-refundable, and non-cancellable once credited to your wallet balance, except where strictly required by statutory consumer protection law or store policies.
- Sending a virtual gift to a host during a live stream or voice room is instantaneous and cannot be reversed or recalled.
- If you experience a technical failure where coins were debited but not credited, contact our support team at humtum.live/contact with your official Google Play or Apple App Store transaction receipt for immediate ledger review and wallet reconciliation.
8. Intellectual Property
The HumTum Live logo, brand name, mobile application design, graphics, sound effects, algorithms, software code, and UI elements are the exclusive intellectual property of HumTum Live Media Technologies. You may not copy, reverse-engineer, decompile, modify, or commercially exploit any part of our platform without prior written permission.
9. Account Suspensions & Termination
We reserve the right to investigate and take disciplinary action against any account that violates these Terms or our Community Guidelines:
- Warning Strike: Issued for minor or inadvertent infractions.
- Stream Mute / Room Ban: Temporary suspension from broadcasting or occupying audio seats for 24 hours to 7 days.
- Permanent Account Termination: Permanent deactivation of the account, forfeiture of remaining coin balances, and hardware device bans for serious or repeated violations.
You may also terminate your account voluntarily at any time by submitting a request via our Account Deletion Portal.
10. Disclaimers & Limitation of Liability
HumTum Live is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, error-free, or virus-free operation of streaming rooms.
To the maximum extent permitted by applicable law, HumTum Live and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, data, or goodwill) arising out of or related to your use of or inability to use the platform.
11. Indemnification
You agree to indemnify, defend, and hold harmless HumTum Live, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from your live broadcast content, your conduct, or your violation of these Terms.
12. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal suit, action, or proceeding shall be instituted exclusively in the competent courts located in India.
13. Modifications, Support & Notices
We may modify these Terms periodically to reflect platform updates, regulatory requirements, or security enhancements. Continued use of HumTum Live after the publication of modified Terms indicates your acceptance.
